1. Acceptance of terms
By accessing or using The Internet Company's website and software solutions, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account and password. You must be at least 18 years old to use our services.
3. Engagements and billing
Custom software engagements are billed according to the payment schedule in your Statement of Work (SOW). Milestone payments are due as specified in the SOW. You can pause or end an engagement at any time subject to the notice period in your SOW. See our Refund Policy for deposit and cancellation terms.
4. Initial consultations
We offer free initial consultations to scope your project. No payment information is required for consultations. Any materials shared during a consultation may be retained for reference.
5. Acceptable use
You agree not to: (a) Use our services for illegal activities. (b) Attempt to access data you're not authorized to access. (c) Reverse engineer or decompile our proprietary tools and frameworks. (d) Resell or sublicense our services without authorization. (e) Interfere with the proper functioning of our services.
6. Intellectual property
We retain all rights to our proprietary tools, frameworks, and content. Client-owned data, custom code delivered under your SOW, and configurations remain the client's property. See your engagement agreement for specific terms.
7. Disclaimers
Our services are provided "as is" without warranties of any kind. We do not guarantee that our services will be error-free or uninterrupted. We are not liable for indirect, incidental, or consequential damages.
8. Limitation of liability
Our total liability for any claim arising from these terms is limited to the amount you paid us in the 12 months preceding the claim. This limitation does not apply to liability for death or personal injury caused by negligence, or liability for fraud.
9. Termination
We may suspend or terminate your engagement if you violate these terms. You may terminate your engagement at any time subject to the notice period in your SOW. Upon termination, project data will be returned or deleted within 30 days unless legally required to retain it longer.
